Terms of Service

1. Who we are

Moxie3D (moxie3d.com) is operated by Kohls RCM Paweł Kohls, ul. Lechicka 59, 61-695 Poznań, Poland, VAT ID PL5542524133 (the "Seller", "we"). Contact: [email protected] or the contact form.

2. Definitions

  • Consumer - a natural person buying for purposes not related to their business. Rules for consumers also apply to a sole trader whose purchase is not of a professional nature for them (Art. 38a of the Polish Consumer Rights Act).
  • Generator - an online tool that creates a 3D-printing or laser-cutting file (e.g. STL, 3MF, DXF/SVG) from parameters you choose.
  • File - digital content generated for you by a Generator.
  • Plan - a monthly subscription (Maker, Seller or Studio) that includes a monthly allowance of Files from all Generators, as shown on the pricing page.
  • Commercial License - the right to sell physical items made from Files, included in the Seller and Studio Plans and in the earlier Commercial License subscription.

3. Services

We provide electronically: a user account, Generators with a live preview, generating and downloading Files, saving designs, Plans, and sale of single Files. Browsing and previewing Generators is free and needs no account; generating and downloading Files requires an account, except for a single File bought without an account.

4. Technical requirements

A device with internet access and an up-to-date browser (Chrome, Firefox, Safari or Edge) with JavaScript and WebGL enabled, and an email address. Files are opened in 3D-printing or laser-cutting software of your choice.

5. Account

You create an account by registering with an email address or Google sign-in; the contract for account services is concluded for an indefinite period and is free of charge. You may delete your account at any time by writing to us. You must not use the service for unlawful content, to infringe third-party rights, to overload or attack the service, or to obtain Files without paying for them. We may block an account that breaches these rules after warning you, unless the breach is severe.

6. Prices and payment

  • Prices are shown in EUR before you order and are final prices including VAT where VAT applies.
  • Payment is made in advance through Stripe (card, Apple Pay, Google Pay and other methods shown at checkout).
  • Free allowance: free Generators up to the daily and monthly limit shown on the site. The limit is shared by all free Generators.
  • Plans: a Plan includes the number of Files per month and per day shown on the pricing page, from all Generators including premium ones. The allowance starts again with every billing period and unused Files do not carry over. Re-downloading a File you already have does not count. Past the allowance, Files are paid for as without a Plan.
  • Single File: a File can be bought directly by card, also without an account, at the price shown in the editor.

7. Delivery of Files

A File is generated and made available for download in your account immediately after you start the generation (usually within a few minutes). Re-downloading the same File is free. Files are kept available in your account for at least 12 months.

8. License to use Files

  • Without an active Commercial License, Files may be used for personal, non-commercial purposes only (making things for yourself, gifts, modifying for your own use). This covers the Free and Maker Plans and single Files.
  • Commercial License (Seller and Studio Plans, and the earlier Commercial License subscription): while it is active, every File you generate or download may be used to make and sell physical items - 3D prints and laser-cut pieces. A File obtained while it is active stays licensed after it ends. Each licensed File has a license ID that anyone can check at /licensing/verify.
  • Never allowed: reselling, sharing or publishing the digital Files themselves, sub-licensing them, or claiming the design as your own.
  • Details: Licensing.

9. Right of withdrawal (consumers)

A consumer may withdraw from a distance contract within 14 days without giving a reason, by sending a clear statement to [email protected]. The withdrawal form template is in Annex 2 to the Polish Consumer Rights Act; using it is optional.

  • Files: a File is digital content not supplied on a tangible medium. By starting the generation of a paid File you expressly request its immediate supply and acknowledge that you thereby lose the right of withdrawal for that File (Art. 38(1)(13) of the Polish Consumer Rights Act). We confirm this in the purchase confirmation email.
  • Plans: you may withdraw within 14 days of the first payment and we refund it in full, as long as you have not downloaded a File on the Plan. By downloading the first File on the Plan you expressly request its immediate supply and acknowledge that you thereby lose the right of withdrawal from the Plan (Art. 38(1)(13) of the Polish Consumer Rights Act). We ask for this request at checkout and confirm it by email. For a Plan started with a free trial (section 10a) the 14 days run from the first payment after the trial; downloading a File during the trial also ends the right of withdrawal.
  • Commercial License subscription: you may withdraw within 14 days of the first payment and we refund that payment in full.

Refunds are made within 14 days of receiving the statement, using the original payment method, at no cost to you.

10. Plans and subscriptions

A Plan is concluded for one month and renews automatically every month until you cancel it in your account (Account → Plan). After cancelling, the Plan stays active until the end of the paid month; no further payments are taken. Switching to another Plan takes effect at once: the difference for the rest of the current billing period is charged or credited straight away, and Files already used in that period stay counted. Apart from section 9, partly used months are not refunded. We will notify you by email at least 30 days before any price change; the new price applies from the next billing period and you may cancel before it. The earlier Commercial License subscription is no longer sold; existing subscriptions continue on the same terms until cancelled.

10a. Photos you share and rewards

  • You can send photos of items made from Files. You confirm that the photo is yours or that you may share it, and that it shows no person who has not agreed to it.
  • By sending a photo you grant us a free, non-exclusive licence to show it on moxie3d.com (generator pages and the home page) with your username and, if you add one, a link to your shop or profile, until you delete the photo in your account. We review every photo and may decline or remove it; links are marked nofollow.
  • If we feature your photo on the home page you get a reward, at most once every 30 days: (a) without an active Plan, a free 15-day trial of a Plan you choose, to be started in your account within 60 days; the trial includes half of the Plan's monthly Files, a payment card is required at the start, and unless you cancel before the trial ends the Plan continues as a paid subscription under section 10; (b) with an active Plan, a credit of half its monthly price, taken off your next invoice. Rewards cannot be exchanged for money or transferred.
  • Files downloaded during a trial of Seller or Studio include the Commercial License, as on a paid Plan.

11. Conformity and complaints

We are responsible for supplying Files and services in conformity with the contract, as provided by the Polish Consumer Rights Act (Chapter 5b). If a File is faulty, incomplete or not as described (e.g. it does not match the chosen parameters), write to [email protected] describing the problem; we may ask for the generation ID. We respond to complaints within 14 days. If the lack of conformity is confirmed we will regenerate the File, or - if that is impossible - refund the price.

12. Out-of-court dispute resolution

Consumers may use out-of-court procedures, e.g. the municipal or district consumer ombudsman (rzecznik konsumentów), the Provincial Inspectorate of Trade Inspection (Inspekcja Handlowa), and information from the Office of Competition and Consumer Protection (uokik.gov.pl). Consumers from other EU countries can find their national bodies on consumer-redress.ec.europa.eu. Using these procedures is voluntary for both parties.

13. Liability

Nothing in these Terms limits the statutory rights of consumers. Towards business customers our liability is limited to the amount they paid us in the 3 months before the claim, and we are not liable for lost profits. Files are generated from parameters you choose; checking whether a design suits your printer, material and intended use is your responsibility.

14. Personal data

We process personal data as described in the Privacy Policy.

15. Changes to the Terms

We may change these Terms for important reasons (changes in law, payment methods or the scope of services). We will publish the new version and notify account holders by email at least 14 days in advance. Purchases already made are governed by the Terms in force when they were made. If you do not accept the changes, you may delete your account and cancel your subscription.

16. Governing law

Polish law applies. This does not deprive a consumer of the protection of the mandatory provisions of the law of their country of habitual residence. For consumers, jurisdiction follows the general statutory rules.
